Refund and Cancellation Policy

Introduction

This Refund and Cancellation Policy (“Policy”) governs all services provided by DigitroNexa (“Company,” “we,” “our,” or “us”). By purchasing or engaging our services, you (“Client,” “you,” or “your”) acknowledge and agree to the terms outlined below.

DigitroNexa provides customized digital marketing, marketing automation, email operations, landing page development, design services, consulting, and related professional services. Due to the customized nature of these services, refunds are subject to the conditions stated herein.


1. General Refund Principles

All payments made to DigitroNexa are considered payments for professional services, expertise, consultation, project planning, design, implementation, and resource allocation.

Because work often begins shortly after project confirmation, complete refunds are generally not available once project activities have commenced.

Refund eligibility shall be determined based on:

  • The type of engagement purchased
  • The amount of work completed
  • Resources allocated to the project
  • Third-party costs incurred
  • Deliverables already provided
  • Contractual obligations agreed upon between the parties.

2. Fixed-Price Projects

Fixed-price projects include, but are not limited to:

  • Email Template Design
  • Landing Page Design
  • Marketing Automation Setup
  • Campaign Build and Deployment
  • CRM Integration Projects
  • Custom Marketing Operations Projects
  • Website Design and Development Services
2.1 Cancellation Before Project Start

If the Client cancels a project before any work has commenced, Digitronexa may issue a refund of up to 100%*** of the amount paid.
***Administrative fees, payment gateway charges, and processing costs may be deducted.

2.2 Cancellation After Project Start

Once project work has commenced, the Client shall be responsible for payment of all work completed up to the cancellation date.

Any refund will be calculated as:
Amount Paid – Value of Completed Work – Third-Party Expenses – Administrative Charges

Digitronexa shall determine the percentage of work completed in good faith based on project records, time allocation, and deliverables produced.

2.3 Completed Deliverables

No refunds shall be issued for:

  • Approved designs
  • Delivered templates
  • Completed landing pages
  • Configured automation workflows
  • Implemented integrations
  • Strategy documents
  • Technical documentation
  • Any deliverable that has been accepted, approved, or utilized by the Client.

3. Milestone-Based Projects

For projects divided into milestones, each milestone shall be considered a separate phase of work.

3.1 Milestone Payments

Milestone payments become non-refundable once:

  • Work associated with the milestone has commenced; or
  • Deliverables for that milestone have been submitted.
3.2 Cancellation Between Milestones

If the Client chooses to terminate the project after completion of a milestone:

  • All completed milestones remain payable and non-refundable.
  • Any upcoming unpaid milestones shall be cancelled.
  • Digitronexa shall deliver completed work for paid milestones upon settlement of outstanding balances.

Monthly retainers may include:

  • Campaign Management

  • CRM Management
  • Technical Support

4.1 Notice of Cancellation

Clients may terminate a monthly retainer by providing written notice at least 30 days prior to the next billing cycle.

4.2 No Mid-Month Refunds

Retainer fees are non-refundable once a billing period has commenced.

No refunds or credits will be issued for:

  • Unused hours
  • Unused support requests
  • Reduced service usage
  • Early termination during an active billing cycle.
4.3 Service Continuation

Services will continue through the end of the paid billing period unless otherwise agreed in writing.


5. Discovery, Consulting, and Strategy Services

Fees paid for:

  • Discovery Workshops
  • Consultation Sessions
  • Audits
  • Strategic Planning
  • Marketing Assessments
  • Technical Assessments

are fully earned upon delivery and are strictly non-refundable.


6. Client Responsibilities

The Client is responsible for providing:

  • Content;
  • Brand assets;
  • Access credentials;
  • Feedback;
  • Approvals;
  • Technical information necessary for project completion.

Delays caused by the Client shall not constitute grounds for refunds.


7. Client Delays and Project Suspension

If required information or approvals are not received within 30 consecutive days:

  • The project may be placed on hold.
  • Digitronexa may reallocate resources to other projects.
  • Additional restart or reactivation fees may apply.
  • No refunds shall be issued for completed work.

Projects inactive for more than 90 days may be deemed abandoned and closed.


8. Third-Party Costs and Software Fees

The following costs are non-refundable under all circumstances:

  • Marketing automation platform fees;
  • Email service provider fees;
  • CRM subscriptions;
  • Hosting charges;
  • Domain registration fees;
  • Advertising spend;
  • Software licenses;
  • Third-party integrations;
  • Premium plugins and extensions.

Such fees remain subject to the terms and policies of the respective providers.


9. Revisions and Quality Assurance

Digitronexa is committed to delivering services consistent with the agreed scope of work.

Where concerns arise regarding deliverables, the Client agrees to provide Digitronexa with a reasonable opportunity to:

  • Correct defects;
  • Make revisions;
  • Address implementation issues;
  • Fulfill agreed project requirements.

Refund requests shall not be considered until such reasonable remediation efforts have been completed.


10. Chargebacks and Payment Disputes

The Client agrees to contact DigitroNexa directly before initiating any chargeback or payment dispute.

Initiating a chargeback without first seeking resolution may result in:

  • Immediate suspension of services;
  • Termination of ongoing projects;
  • Recovery actions for delivered services;
  • Restriction from future engagements.

Digitronexa reserves all rights to provide project records, communications, contracts, approvals, and deliverables as evidence in dispute proceedings.


11. Exceptional Circumstances

Refund requests resulting from exceptional circumstances shall be reviewed on a case-by-case basis.

Approval of any refund remains solely at the discretion of DigitroNexa and shall not establish a precedent for future requests.


12. Limitation of Liability

Under no circumstances shall DigitroNexa be liable for indirect, incidental, consequential, special, or punitive damages arising from service cancellation, project delays, loss of business opportunities, loss of revenue, or marketing performance outcomes.

Any approved refund shall be limited to the actual amount paid by the Client for the affected service.


13. Changes to This Policy

DigitroNexa reserves the right to modify this Policy at any time without prior notice. Updated versions will be posted on this page with a revised effective date.

Continued use of our services constitutes acceptance of the updated Policy.
